Prize-Draw Competition Rules “Paris-Lifestyle Club Benefits”

 

ARTICLE 1
Prisma Corporate Media, subsidiary of Prisma Press Group, located at 13 rue Henri Barbusse, 92230 Gennevilliers (hereinafter referred to as the “organising company”) is organising a free prize-draw competition subject to no purchase obligation on the www.paris-lifestyle.fr website with effect from 1 September 2011, which is open to all individuals who are members of the “Paris-Lifestyle Club” residing in Metropolitan France, Switzerland, Belgium and Luxembourg.
The following individuals are excluded from entering the competition:
-    staff of Prisma Corporate Media and its parent company, Prisma Press, subsidiaries of the latter and their service providers involved in the competition, their family members (ascendants, descendants and direct collaterals) and their spouses;
-    staff of Aéroports de Paris and/or subsidiaries of the latter and their service providers involved in the competition, their family members (ascendants, descendants and direct collaterals) and their spouses;
-    staff of the firm Maîtres Brisse, Bouvet et Llopis, their family members (ascendants, descendants and direct collaterals) and their spouses.

ARTICLE 2
With effect from 1 September 2011, the participants may enter the competition by connecting to the website accessible at the following URL http://www.paris-lifestyle.fr (hereinafter referred to as the “Website”). They must enter their user name and password in the “Paris-Lifestyle Club” section, then input their full contact details, i.e., surname, first name, full postal address and e-mail address.
Online responses shall be referred to hereinafter as the “Entries”.

ARTICLE 3
Entries must be filled out in a legible manner. Only one Entry per household shall be allowed. Household shall mean the same surname and the same postal address.
Entries must be submitted before the deadlines stated on the Website, before midnight. The date and time of the connection to the Website shall be good evidence.
The connection costs to the Website shall be refunded, within one month with effect from the deadline for entries, upon request in writing enclosing a bank details form and proof of submission of an Entry, on a flat-rate basis for an Internet connection, i.e. €0.76. Refunds shall be carried out via bank transfer to the account shown on said bank details form.
It is noted that under the current status of service offers and technology, some Internet access providers offer a free or flat-rate connection to Internet users. It is expressly agreed that any access to the Website carried out for no charge or at a flat rate (including inter alia via cable, broadband or specialised liaison connections) shall not give rise to any refund, insofar as the subscription for the Internet access provider’s services has been taken out in this case by the Internet user for his/her general use of the Internet and the participant’s connection to the Website to enter the competition did not incur him/her any additional costs or expenses.
The organising company reserves the right to demand any proof of submission of an Entry for this competition and it may decide that proof must be produced in order to refund costs incurred submitting an Entry.
Any incomplete Entry or Entry which arrives after the deadline for submission or sent to an incorrect Internet address shall be deemed invalid.

ARTICLE 4
Lots shall be drawn from all Entries received in order to establish the prize-winners of the competition.
In addition to the winning Entries, three reserve Entries shall be drawn from the Entries received, numbered from one to three in the order of the lots drawn. They shall be used in accordance with Article 7 hereinbelow.
The drawing of lots shall take place on the dates stated on the Website at the following address: 13 rue Henri Barbusse – 92230 Gennevilliers.

ARTICLE 5
For each competition session, the organising company shall offer a cultural “surprise prize” (cinema tickets, museum tickets, etc.). The approximate unit sales value of each prize shall be €10.
Conditions relating to awarding prizes:
The prize-winners shall pay for their return trip from their home to the cinema/theatre/museum. In addition, they shall pay for all costs incurred by said trip (accommodation, personal expenses, tips, meals, beverages, transport, etc.).
The organising company’s liability shall be limited to the offer of seats/entrance tickets. It shall accept no liability under any circumstances regardless of any incidents which may occur during the use of said seats/entrance tickets.

ARTICLE 6
6.1 The prizes awarded accordingly may not be returned or exchanged against their monetary value or against any other prize.
Throughout the term of the competition, only one prize may be awarded per household. Household shall mean the same surname and the same postal address.
Prizes shall be personally awarded to the prize-winners named by the drawing of lots as provided for in Article 4 hereinabove. At the prize-winners’ request, they may be awarded on an exceptional basis to any other person named by them.
6.2 Refund requests must be sent to the address shown in Article 13 hereinbelow.
No refund request on behalf of another person shall be accepted.
6.3 The organising company shall take all necessary measures in order to comply with the rules but shall not be held liable if this competition is modified, postponed or cancelled due to any reason whatsoever. Finally, the organising company reserves the right to replace the prize by items of an equal or greater value in the event where said prize is unavailable without any claim being admissible in this respect.

ARTICLE 7
The prize-winners drawn by lots shall be individually informed thereof by letter sent to the address stated on their respective Entries drawn by lots.
In the event where it is not possible to award a winning prize due to any reason whatsoever within one week with effect from the date of the drawing of lots, each undistributed prize shall be awarded to the winner of the first reserve Entry, as provided for in Article 4 hereinabove, and so on up until all of the prizes are awarded.


ARTICLE 8
Any claim or complaint relating to the competition organisation and the awarding of prizes must be sent to Prisma Corporate Media by registered letter (return receipt requested) within one month with effect from the date of the drawing of lots, as provided for in Article 4 hereinabove, at the following address:

ARTICLE 9
Participation in the competition implies understanding and accepting the features and limits of the Internet, in particular with regard to technical performance, times required for loading and submitting responses, lack of protection over certain data against computer embezzlement and potential risks of contamination by viruses circulating on the network.
Therefore, the organising company may not be held liable for the following without this list being exhaustive:
- All information distributed on the services consulted,
- Data transmission
- Any server interruptions,
- In the event of failure of the receiving equipment or telephone lines,
- In the event of loss of data,
- Consequences of any virus or computer bug,
- Any technical failure preventing or limiting the possibility to enter in the competition.
The competition may be withdrawn, interrupted or modified due to factors beyond the organising company’s control which prevent the continuation of the online competition, such as requirements by any authorities, hacking, piracy, etc.
Finally, the organising company reserves the right to replace the prize by items of an equal or greater value in the event where said prize is unavailable without any claim being admissible in this respect.

ARTICLE 10
The prize-winners authorise their surnames, first names and post code to be stated and their photograph to be published for no charge for information or promotional purposes for any use relating to this competition and/or the results thereof in “Aéroports de Paris Magazine” on the Website and on Aéroports de Paris’ social networks.
The above information is essential for the organising company to process Entries. Failing which, Entries cannot be taken into account. This information shall be communicated to the service providers processing them and the organising company’s commercial partners.
As a result of their participation, the participants may receive news, special offers, participate in other competitions, forums, chat lines, blogs, etc., if they are proposed by the organising company, unless they object thereto. Subject to their explicit consent, the participants may also receive offers from the organising company’s partners which may be of interest to them.
In accordance with the Act of 6 January 1978, as amended by the Act of 6 August 2004, participants are entitled to object to data concerning them being used for commercial canvassing. This data may also entitle them to the exercise of the right of access and correction by contacting the organising company.

ARTICLE 11
Participation in this competition entails acceptance of these rules.

ARTICLE 12
Any dispute arising in relation to this competition shall be referred to the court with jurisdiction.

ARTICLE 13
The rules of this competition shall be sent for no charge to any person who requests a copy at the following address:

The postage costs for this request shall be refunded, upon request in writing enclosing a bank details form, based on the cost of the second-class postage stamp applicable in France. No information shall be provided by telephone.

ARTICLE 14
These rules are filed with the firm, SCP Maîtres Brisse, Bouvet et Llopis, Bailiffs in Paris.
